SENATE RESOLUTION NO. 264.

(Submitted by Mr. Neely.)

IN THE SENATE OF THE UNITED STATES,

April 20 (calendar day, April 26), 1938. Resolved, That the Committee on Rules be, and it is hereby, directed to prepare a revised edition of the Senate Rules and Manual for the use of the Seventy-sixth Congress, and that one thousand seven hundred additional copies shall be printed and bound, of which one thousand two hundred copies shall be for the Senate, two hundred copies for the use of the Committee on Rules, and the remaining three hundred copies shall be bound in full morocco and tagged as to contents and delivered as may be directed by the committee.

STANDING RULES FOR CONDUCTING BUSINESS IN THE

SENATE OF THE UNITED STATES

RULE I

APPOINTMENT OF A SENATOR TO THE CHAIR

1. In the absence of the Vice President, the Senate shall choose a President pro tempore.1 [Jefferson's Manual, Sec. IX.

2. In the absence of the Vice President, and pending the election of a President pro tempore, the Secretary of the Senate, or in his absence the Chief Clerk, shall perform the duties of the Chair.

3. The President pro tempore shall have the right to name in open Senate, or, if absent, in writing, a Senator to perform the duties of the Chair; but such substitution shall not extend beyond an adjournment, except by unanimous consent.

4.2 In event of a vacancy in the office of the Vice President, or whenever the powers and duties of the President

Resolved, That it is competent for the Senate to elect a President pro tempore, who shall hold the office during the pleasure of the Senate and until another is elected, and shall execute the duties thereof during all future absences of the Vice President until the Senate otherwise order. After debate, the resolution as amended was agreed to.
