Against the argument that the fraudulent statements for curative powers were not blown in the bottle nor printed on the original label, but carried on accompanying circulars and wrappers, the court threw out the contents of the defence as beside the point, and quotes the law as follows: "That the term 'misbranded,' as used herein, shall apply to all drugs or articles which enter into composition of food the package or label of which shall bear any statement, design or device, regarding such article, or the ingredients or substances contained therein, which shall be false or misleading in any particular."
