AN ACT to Amend Section Three of Chapter One Hundred Ten of the Session Laws of the State of South Dakota of 1905, Relating to Farmers' Institutes, and Providing for Payment of Advertising Thereof.

Be It Enacted by the Legislature of the State of South Dakota:

§ 1. That Section Three of Chapter One Hundred Ten of the Session Laws of the state of South Dakota of 1905 be and the same is hereby amended to read as follows:

Section 3. The necessary and actual expenses incurred in the arranging for and conduct of such institutes, including such machinery, models, maps, charts and other apparatus as shall be needed for the proper presentation of the various subjects, shall be paid out of the appropriation hereinafter provided for, in the manner provided by law for the payment of other state expenses. Provided, that there shall be no expenditures for hall rent, fuel, lights or local speakers, in connection with the holding of such institutes, except when deemed necessary by the institute board. Provided, further, that not to exceed five dollars may be paid for local advertising to one newspaper published in the town or city where such institute is held, and in case there is more than one newspaper published in the city or town where such institute is to be held then he may pay two of such newspapers not to exceed three ($3.00) for such advertising.

§ 2. All acts or parts of acts in conflict with this act are hereby repealed.

§ 3. Whereas, an emergency is hereby declared to exist, this act shall take effect and be in full force from and after its passage and approval.

Fees

PROVIDING DISPOSITION OF FEES RECEIVED BY PUBLIC OFFICERS AN ACT Regulating the Disposition of All Fees of Peace Officers, Receiving a Salary for Services and Fixing Penalty for Violation.

Be It Enacted by the Legislature of the State of South Dakota:

§ 1. Every police officer of all cities of this state, receiving a salary for services, shall account for and pay over to the treasurer of the city, under which he is employed, at the termination of each month of employment, all fees and income obtained by such officer in the service of any civil process or other instrument, taking a receipt from such treasurer for the amounts, so paid.

§ 2. At the termination of each month of such employment, such peace officer shall make and file with the city auditor of such employer, an itemized statement, setting forth the true amount or accounts received by such officer for services of civil process or other instruments, date of such payment and from whom received.

$3. Every police officer of all cities of this state, receiving a salary for services, shall not take or receive any fee or income for the service of any process or instrument, issued out of any court of this state in any criminal case.

§ 4. Any person violating any of the provisions of this act, shall be deemed guilty of a misdemeanor.

§ 5. All acts and parts of acts, inconsistent or in conflict with this act, are hereby repealed.

Fire Proof Buildings

REQUIRING FIRE PROOF STRUCTURES FOR HOSPITAL FOR INSANE.

AN ACT Entitled, An Act Defining and Providing for the Use and Construction of Fire-Proof Buildings for the Permanent Housing of Human Beings by the State of South Dakota.

Be it Enacted by the Legislature of the State of South Dakota:

§ 1. It shall be unlawful for any Board, or any one charged with the designing or erecting of any building for the state of South Dakota or the permanent use and occupancy of human beings, to design, construct or use any building hereafter to be built for the permanent housing of human beings, that shall not be fire-proof, Provided, that nothing herein shall be construed to apply to the construction or use of buildings at the South Dakota Tuberculosis Sanitarium located at Custer, South Dakota.

$ 2. A fire proof building within the meaning of this act is a building, the walls, floors, partitions or ceilings of which, neither contain nor are covered with wood or other inflammable or combustible material. Provided that nothing in this act shall be construed to prevent the use of wood in the construction of doors, door frames and window sash or window frames, nor to wood furring strips to which metal lath is to be applied, nor to the use of rugs and ordinary wood furniture or fixtures.

$3. Any person or persons violating any of the provisions of this act shall be deemed guilty of a felony.

§ 4. repealed.

Firemen's Tournaments

APPROPRIATION FOR ANNUAL EXPENSE.

AN ACT Entitled, An Act Providing for the Holding of Annual Firemen's Tournaments and the Appropriation of Money Out of the State Treasury for the Expenses Thereof.

Be It Enacted by the Legislature of the State of South Dakota:

§ I. Public Institution] That the state firemens association, the same being an association of the municipal fire departments of this state, be and the same is hereby made a public state institution of the state of South Dakota.

§ 2. Appropriation] There is hereby appropriated out of the general fund of the state treasury, not otherwise appropriated, the sum of two thousand ($2,000.00) dollars per annum, to be paid into the treasury of the state firemens association of the state of South Dakota, for the purpose of defraying the expenses of annual tournaments of the municipal fire departments composing said state organization.

§ 3. Annual Tournament] The state firemens association shall hold an annual tournament for the purpose and with the duties among others of examination and drill in the various departments, testing the modern methods and apparatus in the extinguishment of fire and in general to encourage and promote the ability of firemen to protect property, from loss and destruction by fire, at a time to be determined by said association between June 1st and August 1st at any city or town in this state to be selected by said association, provided, the city or town so selected shall contribute and pay into the treasury of said state firemens association a sum of not less than five hundred ($500.00) dollars to be used in paying the usual expenses of said organization in accordance with its existing rules and regulations, or such rules and regulations as it may hereafter adopt.

§ 4. This act expressly repeals Chapter twenty-four of the Session Laws of 1903 for State of South Dakota.

§ 5. Emergency] Whereas, an emergency exists, this Act shali take effect and be in force from and after its passage and approval. Approved March 2, 1911.

Food and Dairy

CHANGING NAME OF STATE DEPARTMENT

AN ACT Changing the Name of the Food and Dairy Department of the State of South Dakota.

Be It Enacted by the Legislature of the State of South Dakota:

§ I. Name Changed] The food and dairy department of the state of South Dakota shall be hereafter known as the food and drug department of the state of South Dakota, and the officer in charge of said department shall be known as the state food and drug commissioner.

§ 2. Whenever and wherever the term "food and dairy department" is uesd in the Statutes and Session Laws of the state of South Dakota, such term shall be hereafter construed to relate to and mean the "food and drug department" of the state of South Dakota, and wherever the term "food and dairy commissioner" is used in the statutes and Session Laws of the state, such term shall be hereafter construed to relate to and mean the "food and drug commissioner".

§ 3. All Acts and parts of Acts in Conflict with the provisions of this Act are hereby repealed.
