former office of headborough or affiftant beadborough of a tithing; and the vacant office fhall be fupplied by a new election in the faid tithing: but the hundreder, and 2 affiftant hundreders, shall still continue to be members of the respective tithings or dozens in which they were originally affociated; that the description of their divifions, and of their refidence, of their neighbours, and of their pledges, may undergo as little change as poffible.

That in the weekly courts of 4 tithings, the hundreder, or one of the affiftant hundreders, fhall prefide in the court of the first 4 tithings of the hundred ; and the town clerk, with one affiftant town clerk, and one affiftant proclamator or usher, fhall attend them: and the proclamator of the hundred, with the other affiftant clerk of the hundred, and the other affiftant proclamator fhall attend the other affiftant hundreder; who, of courfe,

course, must prefide in the court for the remaining 4 tithings, or zd go of the hundred.

That these weekly courts of 4 tithings (or tithing courts) be held every Saturday afternoon, except the last Saturday of the 1st and 2d calendar months in each quarter, which fhall be appropriated to the Hundred Court, or Wappentac: and excepting alfo the last Saturday of every 3d calendar month, which shall be appropriated to a quarterly feffion of 3 or 4 hundreds united, as a court leet, or tithing court, for more important or capital causes.

That the common council of the Settlement be affembled according to the antient established rules of county courts, viz." twice every year," and "more often if need be."

There will likewife be fome public ministers entitled to falaries equally from all the hundreds, as the town clerk of the 1ft hundred, or principal bank, and his extraordinary affiftants (as many as may be wanted) alfo the land furveyor of the whole fettlement, the town marshal of the principal fettlement, and all other officers whofe employments are of fo general a nature as to be connected with the whole fettlement, instead of one ticular hundred.

It is therefore propofed that all officers of the above general defcription shall be amenable only to the great common council of the fettlement, for all charges of misdemeanors or failure of duty in the execution of their respective offices: and for other matters, if they are not included in any tithing, they fhall be refponfible. to the nearest Hundred Court in the. vicinage

With respect to the first chaplain, in alļ ecclefiaftical matters, relating to his function and demeanour as a minifter of the gospel, reference and reprefentation (if thought neceffary by the common council) must be made to the archbishops "and bishops (including the Bishop of "London") that are "members by char

England,)“ for propagating the gospel in foreign parts," who will undoubtedly be ready to give their beft advice and affiftance to promote the general good of the people, and their Chriftian welfare; but in all civil or worldly matters, relating to the first chaplain, the nearest Hundred Court must determine; allow-' ing, however, a right of further appeal to the quarterly leets, or trithings, and laftly,

lastly, to the common council of the fettlement, for a final determination.

The first chaplain, having at present the charge of the whole fettlement, it is fit that his allowance fhould be made equally from every hundred families, and not be charged (as at firft propofed) on a fingle hundred; and yet this fhould be done with fuch due limitation both of profit and duration, as may prevent the eftablishment of any future claim upon the whole fettlement from one clergyman, or rector; which would prevent the employment hereafter of a feparate clergyman to every hundred families; which is moft defirable.-It is therefore propofed that the first clergyman, befides his private lot of land of an equal fize with the other fettlers, and his town lot to defcend to his family, shall have also another town lot of the ordinary fize, as minifter for the time being; and also a glebe
